01. Ownership

The copyright in this Website / Village Directory including all of its contents belongs to the Publisher or, has been included with the consent of other copyright owners. Reproduction in any form, including but not limited to, downloading or printing of part or all of the contents is prohibited except in accordance with the licence granted below in paragraph 2.

02. Licence to Copy for Personal Use

You may print copies of any item in hard copy provided that you do not edit, alter, amend or delete any part of it or combine it with other material. You may recopy the material to individual third parties for their personal information only if you acknowledge the Website / Directory as the source of the information by including such acknowledgement and the address of the Publisher and the Website / Village Directory in the copy of the material. And you must inform the third party that the material may not be copied or reproduced in any way. You may not supply the material to any third party for commercial gain and, no third party shall reproduce the material for commercial gain.

03. Liability

The Publisher makes no warranty in respect of the contents of this Website / Village Directory and accepts no liability for any loss or damage whatsoever or however arising whether directly or indirectly as a result of access to and use of this Website / Village Directory. This includes without limitation acting or failing to act in reliance on any information contained herein.

04. Force Majeure

The Publisher does not warrant that defects within the Website / Village Directory will be corrected, or that the Publisher or the server(s) that makes it available, are free of viruses, bugs or malware.

05. Law

These terms and conditions or, anything other matters regarding the Website / Village Directory and its use will be governed by and construed in accordance with the applicable laws of Wales and England. Furthermore, users agree that all legal proceedings relating to the matters herein shall be adjudicated solely in the courts of Wales and England or, in accordance with such laws and legal principles.

06. Disability Access

We have taken care to ensure that the disabled can access and use this Website / Village Directory. However, we recognised that some people may have personal difficulties in accessing and using this Website / Village Directory. If this is the case please let the Publisher know, see address, telephone number and email address above, so that our obligations to the user can be reasonably realised, and a dialogue can be entered into so that access and use can be facilitated.

07. Submitting Content

If you submit content to the Publisher, including without limitation any text, graphics, photograph, video or audio, you grant the Publisher a licence to use, reproduce, modify, adapt, publish, create derivative works from, distribute and display in public that content in any form and media on or in connection with the Website / Village Directory, at no cost to the Publisher and for as long as we require and you warrant that you own or have rights to the intellectual property in such content and have the right to grant this licence. You waive any moral rights in your contribution. You will indemnify us and keep us indemnified from and against all costs, claims, damages and expenses made against or incurred by us as a result of a third party alleging that the use of such content by us infringes the intellectual property rights of a third party.

08. Submissions

When submitting content, you agree not to do any of the following:

  1. 01. Make submissions that defame, abuse, harass, stalk, threaten or otherwise violate or infringe the rights of any person or entity (including, but not limited to, rights of intellectual property, confidentiality, or rights of privacy, and any rights arising under the Human Rights Act).
  2. 02. Submit any material which is unlawful, indecent, defamatory, hateful or racially, ethnically or otherwise offensive or objectionable, politically sensitive or of an obscene or menacing character, or that may cause annoyance alarm or distress, inconvenience or needless anxiety.
  3. 03. Submit files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received and can prove all necessary consents.
  4. 04. Submit any materials that infringe any patent, trademark, copyright or other proprietary rights of any third party.
  5. 05. Submit material that you do not have a right to make available under any law or contractual or fiduciary relationship, or in breach of confidence or trust.
  6. 06. Cause any computer viruses, macro viruses, Trojan horses, worms, corrupted files or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or other electronic device in the control of the Publisher.
  7. 07. Submit content (or any part thereof) in a way that may cause the system (or the servers or networks connected to the system) to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the system is in any way impaired.
  8. 08. Where you are not the author of any material you are submitting, delete any author attributions, legal notices or proprietary designations within the material.

Acceptance of Advertisements

"the Advertiser" means any person or company placing with the Publisher an order for the publication of an advertisement on this Website / Village Directory.

Orders for insertion of advertisements in the Publication and / or on the Website / Village Directory are accepted subject to the following conditions:

01. Warranty

The placing of an order constitutes a warranty from the Advertiser and / or Advertising Agency to the Publisher:

  1. 01. that the advertisement is legal, decent, honest and truthful, complying with the British Codes of Advertising and Sales Promotion, with any relevant codes of practice and with the requirements of current legislation; and
  2. 02. that the advertisement is not defamatory and does not infringe the copyright, moral rights or any other rights whatsoever of any third party.

02. Links

No hyperlinks or metatags may be included in any advertisements save with the express prior permission, by email, of the Publisher.

03. Indemnity

The Advertiser and / or Advertising Agency agrees to indemnify the Publisher in respect of all costs, claims, damages, or other charges arising directly or indirectly as a result of the publication of the advertisement(s).

04. No Guarentee

While every endeavour will be made to meet the wishes of advertisers, the Publisher does not guarantee the publication of any particular advertisement or its publication on any particular date or in a particular part or edition of the Publication / Website or to be inserted under a particular classification.

05. Errors

It is the responsibility of the Advertiser / Advertising Agency to check the first appearance of any series of advertisements and notify the Publisher immediately of any errors. The Publisher assumes no responsibility for the correction of errors unless notified by the Advertiser by email to the email address set out in these Terms and Conditions. In the event of any error, misprint or omission in the Publication or the Website of an advertisement or part of an advertisement (however caused) the Publisher will either re-publish the advertisement or relevant part of the advertisement as the case may be or make a reasonable refund of or adjustment to the cost. No re-publication, refund or adjustment will be made where the error, misprint or omission does not materially detract from the advertisement.

06. Limitation of Liability

In no circumstances shall the total liability of the Publisher for any error, misprint or omission exceed:

  1. 01. the amount of a full refund of any price paid to the Publisher for the advertisement in connection with which liability arose; or
  2. 02. the cost of a further or corrective advertisement of a type and standard reasonably comparable to that in connection with which the liability arose.
  3. 03. save as set out above, the Publisher accepts no liability in respect of any loss or damage occasioned directly or indirectly as a result of publication of any advertisement or any loss or damage occasioned directly or indirectly by any total or partial failure (however caused) of publication of any advertisement or of any title or website in which any advertisement is or was scheduled to appear.
  4. 04. the Publisher may refuse any advertisement or if already accepted, cancel the order at any time by giving reasonable notice before the next insertion, but in that event, the Advertiser/advertising agency shall not be liable for payment of the difference (if any) between the rates for the series specified in the order and the usual price for the series of insertions which has appeared when the order is stopped; and
  5. 05. any alteration it considers necessary or desirable in any advertisement.

07. Amendments

Will be accepted for publication by the advertiser as long as the amendment is received by the Publisher at least 7 days before publication or printing, as the case may be, by email to the Publisher’s email address in these Terms and Conditions; otherwise, if less than 7 days notice is given, the Publisher will act to amend as soon as is reasonably practicable.

08. Cancellation

The Publisher will require seven clear working days’ notice of cancellation of any order or unexpired part of an order. All cancellations must be notified in writing to the e-mail address at the head of these Terms and Conditions.

09. Payment

Not withstanding the Terms and Conditions set out above, the advertisement submitted by the advertiser must be paid for in full, 7 working days before publication. If payment is not made, the Publisher has the right to not publish the advertisement, but, if the advertisement is published then the advertiser has the right to charge a rate of 10% interest above the Bank of England base rate in respect of any outstanding payment. However, if the Publisher agrees, in writing, that payment may be made on account, the above interest charge comes into effect on the expiry of the accounting period as set out in the account payment agreement.

10. Life of Publication

Each advertisement has a life of one month on the Website / Directory. The Publication may be continued by payment to the Publisher of further appropriate payment agreed by the Publisher as set out above; or, be removed from the Website / Village Directory, if a further appropriate payment is not made.

11. Disclosure of Identity

The Publisher reserves the right to disclose the name and address and any other account details of advertisers and / or agencies to the police, trading standards officials, or any other relevant authority and, where the Publisher in its sole discretion deems it reasonable, to other third parties.

12. Personal Data

All personal data will be held in accordance with the Data Protection Act.
